DISCLAIMER
THIS IS A THIS IS A LEGALLY BINDING RELEASE, WAIVER OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENT (the “Agreement”). Please read it carefully before signing/accepting/acknowledging.
If you are obtaining a quote for and/or securing or procuring travel for more than just yourself, all references below to “I” (and derivations thereof, including without limitation “my” and “me”) shall be read to mean you on behalf of yourself and each individual within your group for whom you are obtaining a quote and/or securing or procuring travel.
TERMS AND CONDITIONS
I understand that Mary Plans Vacations, LLC (hereinafter "Agent") is not the source or supplier of the travel services I have requested, and acts solely as an agent for the actual suppliers of such services. I have been advised that the suppliers whose names appear in the information supplied to me are those who are actually responsible for providing the travel services I have purchased. I consent to and request the use of those suppliers and agree not to hold Agent responsible should any of these suppliers: 1) fail to provide the travel services I have purchased; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission that causes me any sort of injury, damage, delay or inconvenience.
I accept that Agent is not responsible for, nor will I attempt to hold it liable for, any injury, damage or loss I may suffer on account of any conditions, actions or omissions that are beyond its reasonable control. Excepting only liability that directly arises from the gross negligence or willful misconduct of Agent, I will not hold it responsible for any injury, damage or loss I may suffer while on any third party provided or operated excursion or activity.
I will review my travel documents for accuracy upon receipt and understand that I may contact Agent if I have any questions. I understand that it is my responsibility to review the accuracy of all details in the travel quotations provided to me and to confirm the same to Agent.
I understand that all reservation fares typically involve restrictions (including, but not limited to, restrictions related to cancellation) and that changing any aspect of my travel arrangements may result in the payment of additional money.
I understand that the Transportation Security Administration (TSA) requires me to carry a government issued identification card in order to board a flight. I have been advised that the name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on my airline ticket and in my booking records. I acknowledge that my failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing me to miss my flight.
I understand that if traveling internationally, I must have a valid passport and depending upon my destination and nationality, I may need to obtain one or more visas.
I understand that Agent has no special knowledge regarding the financial condition of travel service providers selected for your tour, accommodations or transportation relating to pandemics, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. For information concerning possible dangers at destinations, Agent recommends contacting the Travel Warnings Section of the U.S. State Department at 1-888-407-4747 or www.travel.state.gov. For medical information, Agent recommends contacting the Centers for Disease Control at 1-800-232-4636 or www.cdc.gov/travel.
I assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of my destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s).
I understand that I may purchase travel insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency.
I agree that, where Agent has identified the same in a written communication to me (including via email), a deposit may be required and/or certain itinerary planning charges may be imposed. If the trip is not booked, or if a booked trip is canceled, the deposit would be forfeit and would become compensation to Agent for the work associated with the searching, planning and communication activities. Custom itinerary planning fees may be charged for multi-destination trips and trips that include coordination of multiple modes of transportation (e.g., flights, trains, ground transfers, etc.). With the exception of the immediately previous sentence regarding dining reservations and changes to the same, all other charges will be imposed only if advised in writing (including via email) by Agent.
The laws of the State of California govern the rights and obligations of the parties to this Agreement and the interpretation, construction and enforceability thereof. I agree that any action or proceeding brought by me against Agent shall be brought solely in the courts of California located in Solano County. In the event any action or proceeding is initiated by me in a court outside of Solano County, California, I agree to pay Agent's costs and reasonable attorney fees associated with defending such action or proceeding.

ADDITIONAL TERMS AND CONDITIONS
Passports and Visas
All travelers must have a valid passport for international travel and many countries require at least six (6) months validity from the date of return. Some countries also require a machine-readable passport and/or unstamped available pages. When assisting with an international travel booking, we will assume that all travelers on the booking have a valid passport. If this is not the case, you must let us know. It is important to ensure you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities. Any fines, penalties, payments, delay or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility (except to the extent caused by fault on our part).
If you need information regarding visas, passports and other travel document requirements for your trip, please contact us. We can provide you with general information on visa and passport requirements that apply to international travel bookings you make with us. We can also obtain more specific information from an external visa advisory service provider on your behalf (if you wish, we can obtain visas for you through this external service and fees will apply). We do not warrant the accuracy of visa and passport information provided by any external service and accept no liability for any loss or damage which you may suffer in reliance on it (except to the extent caused by fault on our part).

When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight. Travel Documents
Travel documents include airline tickets, hotel vouchers, rental car vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a travel service provider. Travel documents may be subject to certain conditions and/or restrictions including (without limitation) being non-refundable, non-date-changeable, non-transferable and subject to cancellation and/or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder. An incorrect name on a booking or on the travel documents may result in an inability to travel on that booking and the booking being cancelled. Please review your travel documentation carefully and advise us immediately of any errors in names, dates and timings. You must ensure you have all your travel documents and e-tickets prior to travel. Please let us know if you believe you have not received any required documentation.
A flight described on your travel documents and/or itinerary as “direct” will not necessarily be non-stop. All departure/arrival times are provided by the airlines concerned and are estimates only. They may change due to air traffic control restrictions, weather conditions and operational requirements.
Travel Insurance
For all travel we strongly recommend that you take out appropriate travel insurance to cover your travel arrangements. It is your responsibility to ensure you have valid travel insurance that covers and is appropriate for your needs. We will not be liable for any loss you incur if and insofar as you are able to claim for damages under a travel insurance policy. We can arrange travel insurance for you or provide you with a quote or general information about the travel insurance options available to you.
Health
You must ensure that you are aware of any health requirements and recommended precautions relevant to your travel and ensure that you carry all necessary vaccination documentation. In some cases, failure to present required vaccination documentation (e.g. proof of Yellow Fever vaccination, proof of negative COVID test results, etc.) may deny you entry into a country or invalidate your travel insurance cover. We recommend that you consult with your local doctor, travel medical service or specialist vaccination clinic before commencing your travel. We would be happy to provide you details of travel clinics on request.
Visit the USA State Department Web site www.travel.state.gov on a regular basis for information regarding incidence of disease, terrorism, safety issues, crime, the need for travel documentation (such as passports, visas, proof of health/vaccination certificates), health hazards, and other restrictions regarding travel to your domestic and/or international destination(s), and re-entry into the United States. Required or advised inoculations you decide to obtain upon the advice of your personal physician may need to be administered in a series of doses months ahead of your planned departure and such time element should be taken into account by you when making deposits and/or nonrefundable final payments. Liability
We exercise care in the selection of reputable travel service providers but we are not ourselves a provider of travel services and have no control over, or liability for, the services provided by third parties. We are responsible to ensure that we process your booking with reasonable skill and care and, accordingly, our liability to you (except for fraud, or death or personal injury caused by our negligence) will be limited to supplying the relevant service again or paying the cost of having the relevant service supplied again. Our liability will also be limited to the extent that any relevant international conventions, for example the Montreal Convention in respect of travel by air, the Athens Convention in respect of travel by sea, the Berne Convention in respect of travel by rail and the Paris Convention in respect of the provision of accommodation, limit the amount of compensation which can be claimed for death, injury, or delay to passengers and loss, damage and delay to luggage.
In no event do we accept any liability in contract, tort or otherwise, for any injury, damage, loss, delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control, force majeure or any other event which is beyond our control or which is not preventable by reasonable diligence on our part. We also do not accept any liability in contract, tort or otherwise, for consequential loss (meaning indirect loss, loss of revenue, loss of reputation, loss of profits, loss of actual or anticipated savings, lost opportunities, including opportunities to enter into arrangements with third parties or loss or damage in connection with claims against you by third parties) howsoever caused in connection with your booking.
Special Requirements
Please contact us regarding any special requirements you may have for your travel arrangements such as special meal and seating requests, room type or access. Please understand that travel service providers may not be able to accommodate every request.
Loyalty Programs
Your travelers may provide membership details for loyalty programs at time of booking or add them to their profile. Please encourage your travelers to check their loyalty program for the specific terms of their membership. We cannot guarantee that the travel service provider will credit them with points for their booking. Any loyalty program discrepancies in relation to their booking must be communicated to us within six months of their flight departure date.
Honeymoon & Anniversary Travelers
You must bring a copy of your marriage certificate to qualify for any complimentary honeymoon or anniversary package (photo copy is recommended). Failure to provide such proof of marriage will result in the resort denying the complementary privileges (if applicable). Please notify Mary Plans Vacation, LLC if you are celebrating your Honeymoon or Anniversary so that we can annotate this fact in your reservation. Typically, resorts will honor these packages up to 30 days before or after your honeymoon or anniversary date.
Traveling with Children
Children under 18 years of age, who are not traveling with both parents or legal guardian(s) may need to present a notarized letter from the absent parent or guardian granting permission to travel outside the United States and provide emergency medical care if necessary. Mary Plans Vacation, LLC is not responsible for lack of compliance to provide proper documentation to airport authorities. It is the responsibility of the traveler and the traveler's parents/guardians to provide proper documentation to airport authorities.
Baggage Fees
Due to continual changes in airline baggage policies it is suggested that you inquire with your airline's website for up-to-date fees and information. Mary Plans Vacation, LLC is not responsible for additional fees incurred for baggage or searing. Baggage fees are not part of an all-inclusive package! Please review "Updated Checked Bag and Carry-on Bag Rules" at www.TSA.gov.
Airline Check-in
Please check in with your airline at the airport no later than two (2) hours prior to scheduled flight departure time.
Resort Check in
Check-in time at most resorts is 3:00pm (local time). If you arrive prior to 3:00pm your room may not be ready. The resort will store your luggage in a secure location on property so you may start enjoying your vacation without delay.
Dress Code
Please be advised that some resort restaurants may require a dress code for men which, may require long pants, collared shirts and closed-toe shoes. Therefore, please pack accordingly.
Miscellaneous
Availability and price quotes are applicable to the date and time at which they are requested and cannot be guaranteed until payment is made. Mary Plans Vacation will make every effort to honor the price as originally quoted, however, under certain circumstances additional costs by a supplier or government may be imposed due to an increase in the cost for one or more of the travel components.
Quotes in a foreign currency fluctuate with exchange rates and international payments may carry a foreign transaction fee.
Flight confirmation is subject to availability and prices are subject to change after the date of deposit, including price increases in the fee for a seat assignment, fee for baggage, applicable fuel surcharges, or an increase in a government-imposed fee or tax.
Passport copies are required to confirm international air reservations.
Correct legal names that match identification to be used for travel must be provided to Mary Plans Vacation. Name changes are not permitted on airline tickets. Clients are responsible for providing accurate information on Client Traveler Profile form. Mary Plans Vacation is not responsible for costs incurred by incorrect information provided for travel planning including reservations and airline tickets.
Mary Plans Vacation offers retail travel services to customers, which are provided by separate and independent vendors of travel services. Mary Plans Vacation does not operate, control, or otherwise provide the services of the independent travel vendors. Hence, customer agrees that Mary Plans Vacation acts only as agent for the client in acquiring transportation, hotel accommodations, sightseeing and other privileges, or services for the clients’ benefit, and on the express condition that Mary Plans Vacation shall not be responsible for any loss, accident, injury, delay, defect, omission or irregularity which may occur or be occasioned, whether by reason of any act, negligence or default of any company or person engaged in or responsible for carrying out any of the arrangements, or otherwise in connection therewith.
